The Problem of Luck in Acquiring Tort Justice

• This paper was presented to the Juris North Legal and Political Philosophy Discussion Group. In the philosophy of tort law, there is a historical debate about how whether the system of tort law is justified. The three dominant theories are called universal theories such as law and economics, corrective justice, and civil recourse theory. This paper introduces the Problem of Luck for corrective justice and civil recourse theories. In the last portion of the paper, the author proposes Virtue Jurisprudence to solve the Luck Problem.
